Irrigation Rules and Regulations Comment Submission

  1. Draft Irrigation Rules and Regulations - Public Review

    CVWD is proposing adoption on a rules and regulations policy for the Irrigation System. The policy is currently open for public review and comment. You may view and comment on the rules and regulations until Monday, March 11, 2019. A public meeting to discuss the document and comments will be held Wednesday, March 13, 2019 at 9 a.m. at CVWD's Coachella Office, in the Rummonds Conference Room. Following the public meeting, the CVWD Board of Directors will consider approval of the rules and regulations.

  4. Language added: 27. DISTRIBUTION UNIFORMITY – A term used in irrigation efficiency that measures the consistency of the irrigation event. For a detailed summary, please see "Summary of Changes document above.

  5. All of Part 2 is new language included to be consistent with the regulations governing Sanitation and Domestic Water Service. This language allows the Board of Directors to make changes as it deems necessary, allowing the General Manager to prescribe and enforce additional actions not in conflict with the regulations to implement the application, administration, interpretation and enforcement of these Regulations, allowing CVWD employees with proper credentials to enter property for purposes related to CVWD operations, prohibiting and who is not an authorized officer or employee of CVWD shall have, wear, or exhibit any badge or credentials of CVWD, allowing, under special circumstances, the General Manager to grant a refund of fees or charges at his/her discretion, ensuring that exceptions or exemptions be approved by the Board of Directors.   6. New language has been added to be consistent with the regulations governing Sanitation and Domestic Water Service. This language includes: Canal Water Service, in all cases, shall be the responsibility of the Property Owner. The Property Owner may authorize, in writing, service to be billed to another party, but the Property Owner shall be held responsible for payment of all amounts due to Canal Water Service. If the Property Owner has authorized a second party to receive billing for service, a completed application form shall be required from the second party; The request must indicate Class of Service for the water. Once the application has been received, staff will determine if there is an existing meter, capacity in the pipeline and whether or not the lands are located inside ID1. If there is not an existing water distribution pipeline system to the lands requesting water service, CVWD shall consider the application in conjunction with Part 8 of these Regulations; A deposit may be required for a Temporary Service Connection or construction meter. If required, this deposit is due prior to installation. Please see Appendix A-3 for these charges; Applicant shall submit the previous 12 months recorded well production data with the application. Language was removed that states there is also a cost to relocate an existing temporary service connection or construction meter.   7. Language was removed that requires customers to acknowledge the type of crop when placing water orders because CVWD staff already collects this data; language was removed stating that CVWD would determine if a frost was deemed imminent; language was removed stating that an unscheduled change in order may be placed anytime during normal working hours.   8. All sections included here come from previously approved Guidelines for Colorado River Water Service Agreements for Use Outside Improvement District No. 1 Boundary. Language was revised to say that customers participating in projects outside of ID1 recognize and agree to participate in a program designed to help address the groundwater overdraft problem in ID1 consistent with the Quantification Settlement Agreement of October 10, 2003.   9. Previously approved CVWD Ordinances 1428 and 1434 incorporated, return payment charge language added, existing City of Coachella Ordinance 1017 added, language included to allow for a surcharge for unauthorized operation/tampering, and language added per State Water Code regarding remove of the Irrigation Water Availability Charge.   11. Language included to be consistent with the CVWD Developer Design Manual, to cover potential liabilty for damages to facilities, and require air gap separation of at least one inch. New language has been added stating that canal service is uninterruptible and that backup water supplies are recommended. For a detailed summary, please see "Summary of Changes document above.

  12. This is a new section added to be consistent with the Development Design Manual, Domestic Water System Rules and Regulations, and Revised Canal Water System Right-of-Way Encroachment Policy. For a detailed summary, please see "Summary of Changes document above.

  14. New language is being proposed regarding interuption of canal service, maintenance of the canal, suspension of service, responsibility of system parts, liability and water quality.
